Terms of Service

1. Acceptance of Terms

By creating an account or using BandCut ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. BandCut is operated by its owners ("we", "us", "our").

2. Copyright & Intellectual Property — Your Most Important Obligation

By uploading any audio file to BandCut, you represent and warrant that:

• You are the original creator of the audio, or
• You hold a valid licence that permits you to create derivative works (including stem separations), or
• The audio is in the public domain or released under a licence that explicitly allows derivative processing.

You may NOT upload: commercially released songs from artists or labels you do not represent, music licensed for listening-only (e.g. Spotify, Apple Music, YouTube streams), or any audio for which you have not received written permission from the rights holder to create derivative works.

Uploading copyrighted music without authorisation may constitute copyright infringement under applicable law, including the US Digital Millennium Copyright Act (DMCA), Singapore Copyright Act 2021, and equivalent legislation in your jurisdiction. You are solely responsible for any such uploads.

3. DMCA / Copyright Takedown Policy

We respect intellectual property rights and respond to valid takedown notices submitted under the DMCA and equivalent copyright laws. If you believe content processed through BandCut infringes your copyright, please send a written notice to:

Your notice must include: (a) identification of the copyrighted work; (b) identification of the infringing material; (c) your contact information; (d) a statement of good faith belief; (e) a statement of accuracy under penalty of perjury; and (f) your physical or electronic signature.

We will promptly remove or disable access to allegedly infringing content and may terminate accounts of repeat infringers.

4. Permitted Use

You agree to use BandCut only for lawful purposes. You must not:

• Upload content that infringes third-party intellectual property rights
• Upload content that is illegal, harmful, or obscene
• Attempt to reverse-engineer, scrape, or abuse the Service or its APIs
• Resell or redistribute the Service without our written permission
• Use the Service to process content for commercial redistribution of stems without proper licences

5. Credits & Payments

Credits are purchased through Stripe and are non-refundable unless processing fails due to a technical error on our part. In the event of a processing failure, credits will be automatically refunded to your account. Credits do not expire and hold no cash value.

6. Data & File Storage

Uploaded audio files and processed stems are stored on AWS S3 and are automatically deleted after 7 days. We do not sell or share your files with third parties. Files are encrypted in transit (TLS) and at rest (AES-256). For full details see our Privacy Policy.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT PROCESSING RESULTS WILL MEET YOUR EXPECTATIONS. USE AT YOUR OWN RISK.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BandCut AND ITS OWNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE OR FROM CONTENT YOU UPLOAD. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify, defend, and hold harmless BandCut and its owners from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with: (a) your use of the Service; (b) your violation of these Terms; or (c) your infringement of any intellectual property or other rights of any person or entity.

10. Termination

We reserve the right to suspend or terminate your account at any time, without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately.

11. Governing Law

These Terms are governed by the laws of Singapore. Any disputes shall be subject to the exclusive jurisdiction of the courts of Singapore.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. We will notify registered users of material changes via email.
